I think you are right that findings of fact at an initial tribunal are usually fixed.  But there must be some scope if the tribunal finds a &quot;fact&quot; that turns out not to be a fact.

Also, if the conclusion that the tribunal reached was not one that could reasonably have been reached on the basis of the facts then I think this can be set aside.
